General Terms and Conditions of Use of the Marketplace for Buyers

 1 . Introduction

1.1. "CA International" is the trading name for CA International, which operates an e-commerce platform consisting of a website (“marketplace”), together with supporting IT, logistics, and payment infrastructure, for the sale and purchase of consumer products and services (“products”) in its allocated territory as defined at Appendix 1 (“territory”).

1.2. These general terms and conditions shall apply to you as a buyer on the marketplace and shall govern your use of the marketplace and related services.

1.3. By using our marketplace, you accept these general terms and conditions in full. If you disagree with these general terms and conditions or any part of these general terms and conditions, you must not use our marketplace.

1.4. If you use our marketplace in the course of a business or other organizational project, then by so doing you:

1.4.1. confirm that you have obtained the necessary authority to agree to these general terms and conditions;

1.4.2. bind both yourself and the person, company, or other legal entity that operates that business or organizational project, to these general terms and conditions

1.4.3. agree that "you" in these general terms and conditions shall reference both the individual user and the relevant person, company, or legal entity unless the context requires otherwise.

 2 . Registration and Account

2.1. You may not register with our marketplace if you are under 18 years of age. By using our marketplace or agreeing to these general terms and conditions, you warrant and represent to us that you are at least 18 years of age.

2.2. If you register for an account with our marketplace, you will be asked to provide an email address/user ID and password, and you agree to:

2.2.1. keep your password confidential;

2.2.2. notify us in writing immediately (using our contact details provided at section 26) if you become aware of any disclosure of your password; and

2.2.3. be responsible for any activity on our marketplace arising out of any failure to keep your password confidential, and you may be held liable for any losses arising out of such a failure .

2.3. Your account shall be used exclusively by you, and you shall not transfer your account to any third party. If you authorize any third party to manage your account on your behalf, this shall be at your own risk.

2.4. We may suspend or cancel your account, and/or edit your account details, at any time in our sole discretion and without notice or explanation. However, if we cancel any products or services you have paid for but not received, and you have not breached these general terms and conditions, we will refund you in respect of the same.

2.5. You may cancel your account on our marketplace by contacting us as provided in section 26.

3 .Terms and Conditions of Sale

3.1. You acknowledge and agree that:

3.1.1. the marketplace provides an online location for you to purchase products directly from CA International;

3.1.2. we shall accept binding sales directly with you, and CA International is the party to the transaction with you; and

3.1.3. a contract for the sale and purchase of a product or products will come into force between you and CA International, and accordingly, you commit to buying the relevant product or products upon your confirmation of purchase via the marketplace.

3.2. Subject to these general terms and conditions, the following provisions will govern the contract for sale and purchase between you and CA International:

3.2.1. the price for a product will be as stated in the relevant product listing;

3.2.2. the price for the product must include all taxes and comply with applicable laws in force from time to time;

3.2.3. delivery charges, packaging charges, handling charges, administrative charges, insurance costs, and other ancillary costs and charges will only be payable by you if this is expressly and clearly stated in the product listing;

3.2.4. products must be of satisfactory quality, fit and safe for any purpose specified in, and conform in all material respects to, the product listing and any other description of the products supplied or made available by CA International to you .

3.2.5. in respect of physical products sold, CA International warrants that it has good title to, and is the sole legal and beneficial owner of, the products and/or has the right to supply the products pursuant to this agreement, and that the products are not subject to any third-party rights or restrictions, including in respect of third-party intellectual property rights and/or any criminal, insolvency, or tax investigation or proceedings.
4. Your Order

4.1. Placing an Order

4.1.1. By placing an order for products through our website, you confirm that you intend to enter into a contract with us for the purchase of those products.

4.1.2. You place the order for your products on the website by clicking the 'Confirm Order' button at the end of the checkout process.

4.1.3. During the checkout process, you will be asked to complete your payment details. All fields indicated as compulsory must be completed, which includes providing us with a valid phone number and email address.

4.1.4. We will send you an email confirming receipt, the details of your order, and the delivery costs, which will be added to the purchase price (if applicable).

4.2. Price Changes

4.2.1. We reserve the right to change the prices of the products from time to time, including applying promotions or offers, or if the products are incorrectly priced.

4.2.2. If the actual price of the products is higher than the price at the time of ordering, we will contact you for your instructions before accepting the purchase.

4.3. Order Confirmation

4.3.1. Please note that neither completion of the online checkout process nor our confirmatory email constitutes our acceptance of your order.

4.3.2. Our acceptance of your order will take place only upon receipt of full payment from you.

4.3.3. You can review the orders you have placed and their current status at any time by visiting our website and clicking on "Log In" at the top of the page, followed by selecting "Track Your Order."

4.4. Non-Availability of Products

4.4.1. If we cannot supply you with the products you ordered for any reason, we will not process your order and will inform you of this.

4.4.2. This may be due to the products being out of stock or incorrectly priced.

4.4.3. If you have already paid for the products, we will provide you with a full refund on the card used to make the purchase as soon as reasonably possible.

4.4.4. We shall not be held liable for any delays in the refund process due to bank procedures.
5. Delivery / Collection

5.1. Order Processing

5.1.1. We can only process orders for delivery or collection within countries in which we are permitted to sell the products.

5.1.2. You may opt for the products to either be delivered to your address or to be made available at one of our designated locations for your collection.

5.2. Collection Option

5.2.1. If you opt for collection, you will be prompted to choose a convenient pickup location when providing your address details during checkout.

5.2.2. Please note that delivery charges and timescales may vary depending on the type of products ordered, the service you select, and the delivery address.

5.2.3. For cash on delivery orders, parcels can only be opened after accepting and paying for your order.

5.3. Delivery Timeframes

5.3.1. We will make every effort to deliver the products to your address by the estimated delivery date provided in your order confirmation email.

5.3.2. If we are unable to meet this estimated date, we will promptly notify you with an updated timeframe.

5.3.3. Once your order has been delivered to your address, we will inform you accordingly.

5.4. Missed Deliveries

5.4.1. If you have selected delivery to your address and no one is available at the specified address at the time of delivery, our delivery company will contact you to arrange re-delivery.

5.4.2. The products will only be left with a third party (such as a building caretaker) with your express authority.

5.5. Risk and Responsibility

5.5.1. All risk in the products you order (including risk of loss and/or damage to the products) shall pass to you when they are delivered to the delivery address specified in your order, or collected from our location (as appropriate).

5.5.2. We will not be liable for a refund or a replacement of the products in the event the address you specified is incorrect.

5.5.3. Occasionally, the supply of your products may be delayed or prevented for reasons beyond our control (e.g., due to extreme weather, customs delays, etc.). We will make every effort to keep you informed but are not liable for delays due to such events.
6. Authorized Card Holder

6.1. Placing an Order

6.1.1. You may place an order for products on our platforms by selecting the product(s) you wish to purchase, adding them to your basket, and then completing the checkout process (an "Order").

6.1.2. During the checkout process, you will be asked to provide several details. All fields indicated as compulsory must be completed in order for us to process your order.

6.1.3. This includes providing us with your name, delivery address (if applicable), payment details (except where cash on delivery is selected), a valid telephone number, and email address.

6.2. Personal Information

6.2.1. Any personal information that you provide to us will be managed by us in accordance with our Privacy Policy.

6.3. Credit/Debit Card Use

6.3.1. Where you use a credit or debit card to pay for your order, you confirm that the credit/debit card being used is yours or that you have been specifically authorized by the owner of the credit/debit card to use it.

6.3.2. All credit/debit card holders are subject to validation checks and authorization by the card issuer.

6.3.3. If the issuer of your payment card refuses to authorize payment to us, we will not be liable for any delay or non-delivery of your order.

7. Wrong Address

7.1. Risk in Returns

7.1.1. For returns related to online purchases, all risk (including risk of loss and/or damage to the products) shall pass to you when they are delivered to the address specified in your order.

7.1.2. We will not be liable for a refund or replacement in the event the address you specified is incorrect.

 

8. Return Policy for CA International

8.1. Introduction

8.2.1. Eligibility for Return

  • Products must be returned within 14 days of receipt.

8.3.2. Approval and Return Authorization

  • Once the return request is received, it will be reviewed within 2 business days.
  • If the return is approved, a Return Authorization (RA) number will be provided, along with instructions on how to return the item.
  • Returns without an RA number will not be accepted.

8.3.3. Return Shipping

  • The buyer is responsible for return shipping costs unless the item is defective, damaged, or incorrectly sent by CA International.
  • In cases where CA International is responsible for the error, we will provide a prepaid shipping label.

8.3.4. Return Address

  • Returns must be sent to the address provided with the RA number. The return address may vary depending on the product category and the warehouse from which it was shipped.

8.4. Exchanges

8.4.1. Exchanges

  • Exchanges are not available. We ensure that all product information is fully detailed and accessible for customers to review before placing an order and confirming payment.
  • Please make sure to carefully select the correct size, color, and other specifications before finalizing your purchase.
  • If you need to return an item, please follow our Return Process for further instructions.

8.4.2. Non-Refundable Items

  • Items that are non-returnable as per Section 8.2.2 are also non-refundable.

8.5. Defective, Damaged, or Incorrect Items

8.5.1. Reporting Issues

  • If an item arrives defective, damaged, or incorrect, buyers must notify CA International within 7 days of receipt.

  • CA International will offer a replacement, repair, or refund based on the nature of the issue and the buyer’s preference.
  • In cases where a replacement is not available, a full refund will be issued.

8.5.3. Return of Defective or Incorrect Items

  • For defective or incorrect items, CA International will provide a prepaid return shipping label.
  • The item must be returned within 15 days after the return label is issued.

8.6. Responsibilities of Buyers and Sellers

8.6.1. Buyer Responsibilities

  • Ensure accurate information is provided during the return process.
  • Return items securely packed and in accordance with the guidelines provided by CA International.
  • Cover return shipping costs unless otherwise specified in this policy.

8.6.2. Seller Responsibilities

  • Provide clear and accurate product descriptions to avoid misunderstandings.
  • Respond promptly to return requests and provide necessary documentation and instructions.
  • Process refunds or exchanges in a timely manner, adhering to the timelines specified in this policy.

8.7. Dispute Resolution

8.7.1. Initial Resolution

  • Most disputes can be resolved through direct communication between the buyer and CA International.
  • Buyers are encouraged to contact our customer service if they are not satisfied with the outcome of a return or refund.

8.7.2. Third-Party Mediation

  • If a dispute cannot be resolved through direct communication, either party may request mediation from a third-party service agreed upon by both parties.
  • The costs of mediation will be shared equally between the buyer and CA International unless otherwise agreed.

9. Return Process
